Please read these Terms of Service carefully before using Etch Fitness. By downloading or using the app, you agree to be bound by these terms. If you do not agree, do not use the app.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Etch Fitness mobile application ("App"), operated by Etch Fitness ("we", "our", or "us"). By creating an account or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms.
We may update these Terms at any time. Continued use of the App after changes constitutes your acceptance of the revised Terms.
2. Description of Service
Etch Fitness provides an AI-powered fitness tracking platform that includes:
- Physique analysis using computer-vision AI (photos are analysed to score muscle development)
- Meal scanning and nutritional analysis via AI image recognition
- Personalised workout plan generation based on your fitness profile
- Nutrition goal tracking and meal logging
- Progress tracking over time through repeated analyses
Features available depend on your subscription tier. Free tier users receive one lifetime physique analysis. Pro tier users receive unlimited analyses, meal scanning, and personalised plans.
3. User Accounts
To use Etch Fitness, you must create an account using Apple Sign In or Google Sign In. You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access at contact@etchfitnessapp.com
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Payments
Etch Fitness offers the following subscription plan:
- Physique Pro — $7.99 CAD/month or $69.99 CAD/year. Includes unlimited physique analyses, meal scanning, and personalised workout and nutrition plans.
Billing
Subscriptions are billed through your Apple App Store account. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Cancellation
You may cancel your subscription at any time through your iPhone Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access until then.
Refunds
All purchases are processed by Apple and are subject to Apple's refund policy. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com.
Price Changes
We reserve the right to change subscription prices. You will be notified of price changes before they take effect and given the opportunity to cancel.
5. AI-Generated Content Disclaimer
Important: AI-generated content in Etch Fitness is for informational and motivational purposes only. It does not constitute professional medical, nutritional, or fitness advice.
The physique analyses, workout plans, nutritional recommendations, and scores produced by Etch Fitness are generated by artificial intelligence. You acknowledge and agree that:
- AI analysis results may not be accurate, complete, or suitable for your individual circumstances
- Etch Fitness is not a substitute for advice from a qualified doctor, registered dietitian, certified personal trainer, or other healthcare professional
- You should consult a qualified professional before making significant changes to your diet or exercise routine, especially if you have any medical conditions
- You use AI-generated recommendations entirely at your own risk
- Etch Fitness makes no warranty, express or implied, regarding the accuracy of AI-generated content
We are not liable for any injury, illness, or adverse outcome resulting from reliance on AI-generated content within the App.
6. User Responsibilities and Acceptable Use
By using Etch Fitness, you agree to:
- Provide accurate information in your profile to receive relevant AI recommendations
- Only upload photos of yourself that you have the right to use
- Not upload photos of other people without their explicit consent
- Not use the App for any unlawful purpose or in violation of any applicable laws
- Not attempt to reverse-engineer, decompile, or tamper with the App or its servers
- Not use automated tools to access the App or its API in an unauthorised manner
- Not share your account credentials with others
We reserve the right to remove content and terminate accounts that violate these responsibilities without prior notice.
7. Intellectual Property
All content, code, design, trademarks, and materials within Etch Fitness are the property of Etch Fitness or its licensors and are protected by applicable intellectual property laws.
You retain ownership of any photos and personal data you provide to the App. By uploading content, you grant us a limited, non-exclusive licence to process that content solely to provide the services described in these Terms.
You may not reproduce, distribute, or create derivative works from Etch Fitness content without our express written permission.
8. Disclaimers and Limitation of Liability
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Etch Fitness shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, profits, or goodwill
- Physical injury or health consequences arising from use of the App
- Temporary or permanent unavailability of the App or its features
- Inaccuracy of AI-generated analyses, plans, or recommendations
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms or if we discontinue the service. You may stop using the App and delete your account at any time by contacting us at contact@etchfitnessapp.com.
Upon termination, provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will remain in effect.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
